Service Credits

If we fail to meet our uptime commitments, eligible customers may receive service credits as compensation. Service credits are calculated based on the duration and impact of the outage.

Limitation of Liability

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including:

  • • Accuracy, reliability, or completeness of transcriptions

Limitation of Damages

To the maximum extent permitted by law, our total liability arising out of or related to these Terms or the Service shall not exceed:

  • For paid subscribers: the fees paid by you in the 12 months preceding the claim
  • For free users: $100 USD

Exclusion of Consequential Damages

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, even if we have been advised of the possibility of such damages.

Termination

Termination by You

You may terminate your account at any time by:

  • Accessing the account settings in your dashboard
  • Following the cancellation process for your subscription
  • Contacting our support team for assistance

Termination by Us

We reserve the right to terminate or suspend your account immediately, without prior notice, for:

  • Violation of these Terms of Service
  • Suspicious or fraudulent activity

  • Discontinuation of the Service

Effect of Termination

Upon termination:

International Users

The Service is controlled and operated from the United States. If you are accessing the Service from outside the United States, you are responsible for compliance with local laws.

Miscellaneous

Entire Agreement

These Terms constitute the entire agreement between you and CallQA regarding the Service and supersede all prior agreements, communications, and understandings.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of these Terms must be in writing and signed by an authorized representative of CallQA.

Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign or transfer these Terms at our discretion.
